Terms of Service

These terms govern your access to and use of T-care Africa's healthcare technology products and services. Please read them carefully.

1. Acceptance of Terms

These Terms of Service (“Terms”) form a binding agreement between you and T-care Systems Ltd(“T-care Africa”, “we”, “us”, or “our”) governing your use of the T-care Plus mobile application, the T-care HMS platform, the HiSynq platform, our websites, and related services (collectively, the “Services”).

By accessing or using the Services, creating an account, or ticking the box to accept these Terms, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.

2. Definitions

  • “Services” means the T-care Plus app, T-care HMS, HiSynq, our websites, and all associated features and content.
  • “Facility” means a hospital, clinic, laboratory, pharmacy, or other healthcare provider that uses T-care to deliver care to you.
  • “Account” means the personal account you create to access the Services.
  • “Content” means any information, data, images, or materials you submit to the Services.

3. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. You may manage records for a minor or dependent only if you are their parent or legal guardian, or are otherwise legally authorised to do so, and you accept these Terms on their behalf. By using the Services you represent that the information you provide is true, accurate, and complete.

4. Accounts & Security

You register using your phone number and a one-time passcode (OTP), and you secure your account with a personal PIN. You are responsible for:

  • Keeping your PIN and device confidential and secure;
  • All activity that occurs under your account;
  • Providing accurate registration details and keeping them up to date;
  • Notifying us promptly at tcareafrica@gmail.com if you suspect any unauthorised use of your account.

You may not share your account, impersonate another person, or register on behalf of someone without authorisation.

5. The Services

The Services enable you to, among other things:

  • Register with one or more healthcare facilities;
  • Verify your identity;
  • Book appointments and healthcare services;
  • Make payments through linked mobile-money providers;
  • View your medical reports, laboratory and imaging results, and prescriptions;
  • Receive appointment, results, and account notifications.

Features may vary by facility, country, and over time. We may add, change, suspend, or remove features at our discretion. Some features depend on your healthcare facility and may be unavailable if a facility does not offer them.

6. Medical Disclaimer

T-care Plus is not a substitute for professional medical care.

The Services help you access and manage healthcare information and appointments. They do not provide medical advice, diagnosis, or treatment, and the information shown in the app is for your reference and convenience only.

Always rely on the judgement of a qualified healthcare professional regarding any medical condition or treatment. In a medical emergency, contact your local emergency services or go to the nearest hospital immediately. Do not delay seeking professional care because of something you read in the app.

Medical records and results are created and provided by your healthcare facility. We are not responsible for the clinical accuracy or completeness of records entered by a facility. If you believe a record is incorrect, contact your facility and you may also submit a correction request through the app.

7. Identity Verification

To protect patients and maintain accurate records, the Services include an identity verification (KYC) process in which you may submit images of your government-issued ID and facial / liveness images. You agree to provide genuine, current documents and images that belong to you (or to the dependent you are authorised to represent). Submitting false, altered, or fraudulent documents is prohibited and may result in suspension or termination and may be reported to the relevant authorities. We may approve, reject, or require additional or in-person verification at our discretion.

8. Payments & Fees

Where the Services allow you to pay for healthcare services, payments are processed through third-party mobile-money providers (such as Wave and Waychit) that you link to your account. By initiating a payment you authorise the charge for the selected service and amount.

  • Service prices are set by the relevant facility and are shown before you confirm a booking.
  • Payment processing is subject to the terms, limits, and fees of your mobile-money provider.
  • Refunds, cancellations, and disputes for healthcare services are governed by the policies of the facility that provided the service. Contact the facility for refund-related requests.
  • You are responsible for ensuring the wallet and phone number you link are yours and have sufficient funds.

9. Appointments & Bookings

Appointment requests made through the Services are subject to confirmation and availability at the chosen facility. A booking does not guarantee a specific provider or time, and facilities may reschedule or cancel appointments. You are responsible for attending or cancelling appointments in good time and for the accuracy of the booking details you provide.

10. Acceptable Use

You agree not to:

  • Use the Services for any unlawful, fraudulent, or harmful purpose;
  • Access, tamper with, or use accounts, data, or records that are not yours without authorisation;
  • Upload viruses, malicious code, or attempt to disrupt, overload, or compromise the Services or their security;
  • Reverse engineer, decompile, scrape, or copy the Services except as permitted by law;
  • Misrepresent your identity or your relationship to a patient record;
  • Infringe the rights of others or violate any applicable law or regulation.

11. Your Content

You retain ownership of the Content you submit. You grant us a limited, non-exclusive licence to use, store, and process your Content solely to operate and provide the Services to you and the facilities you select, as described in our Privacy Policy. You are responsible for ensuring you have the right to submit any Content you provide, and that it is accurate.

12. Intellectual Property

The Services, including all software, design, text, graphics, logos, and the names “T-care”, “T-care Plus”, “T-care HMS”, and “HiSynq”, are owned by T-care Systems Ltd or its licensors and are protected by intellectual-property laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Services for their intended purpose. You may not copy, modify, distribute, sell, or create derivative works from any part of the Services without our prior written permission.

13. Third-Party Services

The Services integrate with third-party providers, including mobile-money platforms, mapping / location services, SMS / OTP delivery, and cloud infrastructure. Your use of those services may be subject to their own terms and policies. We are not responsible for the acts, omissions, availability, or content of third parties.

14. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal and health information. By using the Services you consent to those practices.

15. Disclaimers

The Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, secure, or that records and information will always be accurate, complete, or available.

16. Limitation of Liability

To the maximum extent permitted by applicable law, T-care Systems Ltd and its directors, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the Services. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence.

17. Indemnification

You agree to indemnify and hold harmless T-care Systems Ltd and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Services, your violation of these Terms, or your infringement of any law or third-party right.

18. Suspension & Termination

You may stop using the Services and request deletion of your account at any time. We may suspend or terminate your access to the Services, with or without notice, if you breach these Terms, if we are required to do so by law, or to protect the Services or other users. Upon termination, your right to use the Services ends, though provisions that by their nature should survive (such as intellectual property, disclaimers, and limitation of liability) will continue to apply. Certain records may be retained as described in our Privacy Policy.

19. Changes to the Terms

We may update these Terms from time to time. We will revise the “Last updated” date above and, for material changes, provide additional notice through the app or by other means. Your continued use of the Services after the changes take effect constitutes acceptance of the updated Terms.

20. Governing Law & Disputes

These Terms are governed by the laws of the Republic of The Gambia, without regard to its conflict-of-laws rules. You agree that the courts of The Gambia have jurisdiction over any dispute arising out of or relating to these Terms or the Services, without prejudice to any mandatory consumer-protection rights you may have in your country of residence. Before starting formal proceedings, we encourage you to contact us so we can try to resolve the matter informally.

21. General

  • Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and us regarding the Services.
  • Severability: if any provision is found unenforceable, the remaining provisions stay in full effect.
  • No waiver: our failure to enforce a provision is not a waiver of our right to do so later.
  • Assignment: you may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or reorganisation.
